Hainan FTP Customs Closure 2026: Zero Tariff & EF Accounts

Hainan FTP customs closure explained: check zero-tariff goods, EF accounts, tax conditions and a 10-step action plan for foreign companies.

“Customs closure” sounds like a border shutting. In the Hainan Free Trade Port, it means almost the opposite. On 18 December 2025, Hainan activated island-wide independent customs operations, redrawing the customs boundary so eligible goods can enter from overseas under a broader zero-tariff regime while movements from Hainan into mainland China remain controlled.

For a foreign company, the result is not a blanket tax holiday or an unregulated offshore zone. It is a new operating architecture: a more open “first line” with overseas markets, a regulated “second line” with mainland China, freer circulation inside the island, and a ring-fenced EF account system for eligible cross-border funds. This guide explains what changed, what did not, and what a business should verify before committing capital. Unless otherwise stated, the post-closure operating data below are as of 31 July 2026 and were released at the Hainan Provincial Government press conference on 29 August 2026.

1. What Hainan FTP Customs Closure Actually Means

The core misconception should be removed first: customs closure does not mean Hainan is closed. Hainan remains part of China. The island-wide operation establishes a special customs-supervision framework around Hainan Island; it does not create a new national border, change immigration law, or turn every transaction into an offshore transaction.

The framework is commonly summarized as “first line opened up, second line controlled, and free circulation within the island.” Those phrases describe three different movements:

One commercial cycle can cross both lines. A German component may enter Hainan, be processed there, and then cross the second line as a finished product sold to Guangdong. The company must model each leg separately.

The official goods policy confirms the structure. Eligible Hainan entities importing goods outside the import taxable-goods catalogue may receive relief from import duty, import value-added tax and consumption tax at the first line. When zero-tariff goods or products made from them enter mainland China through the second line, import taxes generally become payable. A qualifying processed product can receive import-duty relief if an encouraged-industry enterprise meets the statutory value-added threshold, but domestic import VAT and consumption tax remain governed by the applicable rules. A Hainan business licence alone does not make a shipment duty-free. Classification, importer, use, processing, value, buyer and destination all matter.

2. Hainan Zero Tariff: Coverage Expanded from 21% to 74%

The most visible change after customs closure is the scale of the zero-tariff regime. Under the post-closure goods policy, the share of tariff lines potentially covered rose from 21% to 74%, or more than 6,600 tariff lines. The regime moved from several positive lists toward an import taxable-goods catalogue: for a qualifying entity, goods outside that catalogue may potentially receive zero-tariff treatment, subject to the other customs, import-permission and regulatory requirements.

That word “potentially” is essential. Zero tariff does not mean every imported product is tax-free. A company must confirm at least five questions:

  1. Is the importer an eligible entity registered in Hainan and recognized for the regime?
  2. What is the exact HS code and is the item outside the current import taxable-goods catalogue?
  3. Is the product prohibited, restricted, quota-controlled, subject to trade remedies, or dependent on inspection, quarantine, food, medical-device or other approvals?
  4. Will the goods be used or circulated in a permitted way and recorded in the required customs account?
  5. Will the goods stay in Hainan, move to another eligible Hainan entity, or cross the second line into mainland China?

From the customs launch through 31 July 2026, zero-tariff imports reached RMB 3.624 billion, up 40.1% year on year, and reduced duties and taxes by RMB 598 million, according to the Hainan Provincial Government press conference on 29 August 2026.

The 30% value-added rule is not a transshipment shortcut

The second major opportunity concerns goods processed in Hainan and then sold into mainland China. A filed encouraged-industry enterprise may qualify for exemption from import duty when its Hainan processing creates at least 30% value added and all customs conditions are met. The rule is designed for substantive processing, not for routing an unchanged import through Hainan.

A feasibility model should identify imported and domestic inputs, the finished-product selling price, customs valuation and production steps. Relabelling, repackaging, splitting or basic cutting may fail the substantive-processing requirement.

The exemption also needs to be described precisely: qualifying second-line processed goods may be exempt from import duty, but import-stage VAT and consumption tax, where applicable, are not automatically eliminated. In the period through 31 July 2026, qualifying value-added processed goods sold into mainland China reached RMB 759 million, with RMB 44.6066 million in customs duty relieved, according to the Hainan Provincial Government’s 29 August 2026 scorecard.

3. EF Accounts: The Cross-Border Capital Pipeline Now Running

Customs treatment solves only the goods side of the transaction. A foreign company also needs a lawful route for capital contributions, supplier payments, export proceeds, loans, dividends and treasury movements. Hainan’s multi-functional free trade account, commonly called the EF account, is the financial infrastructure designed for that role.

The system has four holder categories:

By mid-2026, People’s Bank of China Hainan Branch data recorded 13 participating banks and nearly 1,300 cumulative EF accounts. A June disclosure reported 105 countries and regions and cumulative business above RMB 600 billion since May 2024. The Hainan Provincial Government’s 29 August scorecard also reported volume above RMB 600 billion. These system figures do not promise approval or fixed transfer times.

First-line convenience does not remove bank review

Across the first line, eligible transfers between EF accounts and specified overseas, offshore, non-resident or other EF accounts can generally be processed on payment instructions in RMB or foreign currency. “On instruction” does not mean anonymous, undocumented or unrestricted. The bank still applies know-your-customer, know-your-business and transaction due-diligence principles, as well as anti-money-laundering, sanctions, authenticity and ongoing-monitoring controls. It may request contracts, invoices, customs records, investment approvals, tax evidence, resolutions or beneficial-ownership documents.

Across the second line, funds are managed as cross-border flows. A Hainan entity’s EFE account and its same-name ordinary account opened with a bank inside the FTP may transfer RMB within a limited-penetration quota. The standard two-way ceiling is calculated by reference to the enterprise’s prior-year owners’ equity:

Net inflow or net outflow ceiling = prior-year owners’ equity × macro-prudential parameter × inflow or outflow leverage ratio.

Where each current parameter is 1, the practical ceiling is one times the relevant owners’ equity. A company without the prior-year report or registered for less than six months may face a different basis, including 50% of owners’ equity in the latest audited report under the applicable account rules. Parameters are regulatory variables and should be reconfirmed with the bank before execution.

The negative list for same-name second-line penetration generally prohibits funds from being used directly or indirectly for:

  • expenditure outside the business scope or prohibited by law;
  • securities or other investment and wealth-management activity, except permitted low-risk products and other express exceptions;
  • loans to unrelated enterprises unless lending is expressly permitted within the business scope; or
  • construction or purchase of non-self-use real estate.

Transfers between EFE and non-same-name ordinary onshore accounts are narrower and generally tied to goods-trade settlement treated by customs as import or export. The correct account path depends on the holder and transaction, so an EF account should never be marketed as a “free transfer channel.”

4. Tax Incentives Remain Available—and Conditional

Customs closure did not turn Hainan into a universal 15% tax jurisdiction. The headline corporate and individual incentives remain valuable, but both are conditional and currently time-limited.

15% corporate income tax

The preferential 15% corporate income tax (CIT) rate was extended through 31 December 2027 under Finance and Taxation Notice 2025 No. 3. A company generally needs to satisfy three connected gates:

  1. its main business falls within an applicable encouraged-industry catalogue;
  2. qualifying main-business revenue represents at least 60% of total revenue; and
  3. the company conducts substantive operations in Hainan.

Substantive operation is an evidence test, not a registration slogan. Authorities look at whether the company’s real production or business activity, personnel, accounting and assets are based and managed in Hainan. In practice, governance records, contracts, delivery, payroll, workplace, books, bank flows and asset use should tell a consistent story. A nominal address, outsourced staff and offshore decision-making may undermine the claim even if the business scope contains an encouraged-industry phrase.

Both 15% rates require genuine Hainan substantive operations — including, for employers with under 10 staff, at least three residents meeting the 183-day test — and are not triggered by registration alone.

15% individual income tax burden cap

The personal incentive is also frequently overstated. It is not a flat 15% payroll rate for every employee. Under Finance and Taxation Notice 2025 No. 4, qualifying high-end and urgently needed talent may receive an exemption for the part of their actual individual income tax burden exceeding 15% on specified Hainan-source income, subject to the current eligibility and annual-settlement rules. The current period also runs through 31 December 2027.

5. The Post-Closure Scorecard: Roughly Eight Months of Operation

The most useful question is no longer whether the customs system will launch. It launched on 18 December 2025. The question is whether goods, people and funds are actually moving under the new framework.

The following table uses the Hainan Provincial Government press conference of 29 August 2026, with operating data through 31 July 2026, except the final foreign-investment row, which uses State Administration for Market Regulation data reported by Xinhua on 29 August 2026.

The official customs and mobility figures are available in the government-published post-closure scorecard. The 38.6% figure comes from the State Administration for Market Regulation data reported by Xinhua. Keeping those sources separate prevents a common statistical error: growth in newly registered foreign-invested enterprises is not the same as growth in trade value or actual foreign capital used.

The scorecard demonstrates execution, but cannot show whether a product clears the taxable catalogue, processing is substantive, the CIT ratio is met, or a bank will accept a particular EF transaction.

6. Ten-Step Checklist for Foreign Companies

1. Map the supply chain by HS code and border line

List each imported input, equipment item and finished product by proposed HS code, origin, importer, Hainan use and final destination. Mark when it crosses the first line, stays within Hainan, or crosses the second line. Do not price the benefit from a product name alone.

2. Test the 6,600-plus tariff-line opportunity

Compare each exact code with the current import taxable-goods catalogue and other exclusions. Then check import permissions, quotas, inspection, quarantine, food, medical, technology and trade-remedy rules. Record the version and date used.

3. Build substantive-operation evidence from day one

Decide where management decisions, employees, accounting, contracts, delivery and assets will sit. A Hainan registration should reflect a Hainan operating reality if the company expects to claim FTP tax treatment.

4. Select the correct EF account and bank

Define whether the applicant is a Hainan institution, overseas institution, eligible overseas individual or financial institution. Prepare the ownership chart, beneficial owners, business plan, licences, premises evidence, counterparties, expected currencies, countries, volumes and twelve-month transaction forecast. Compare banks by the required use case, not by logo.

Draw capital contribution, goods trade, service fees, loans, royalties, dividends and group treasury as separate arrows. Identify the payer, payee, currency, contract, approval, tax and bank evidence for each. An EF account is the payment rail, not the legal basis for the payment.

6. Validate the 30% processing model before investing

Prepare a bill of materials, production flow, valuation method and sensitivity model. Confirm that the Hainan activity is substantive and that the encouraged-industry enterprise can make the required customs filings. Stress-test selling prices and input costs rather than relying on one forecast ratio.

7. Build the CIT eligibility file

Quote the exact encouraged-industry entry, map products or services to it, define qualifying and non-qualifying revenue accounts, and monitor the 60% threshold during the year. Link tax analysis to contracts, invoices and delivery evidence.

8. Identify individuals who may qualify for the IIT cap

Review talent or income eligibility, actual work in Hainan, residence days, Hainan-source income and employer substance. Do not offer a “15% salary tax” in an employment package before the person-specific test is complete.

9. Review data and outbound-investment compliance

10. Model the 2027 policy boundary

Run at least two tax cases: benefits available through 31 December 2027 where the company qualifies, and a conservative post-2027 case without assuming renewal. Place official-policy review dates in the board and budgeting calendar.

7. Common Hainan Customs Closure Myths

Myth Fact
“Customs closure means Hainan is closed to foreign business.” The opposite is closer to the truth: the closure activates the special customs boundary that supports broader eligible first-line zero-tariff imports while regulating the second line.
“All goods imported into Hainan are tariff-free.” Only qualifying imports by eligible entities and outside the taxable-goods catalogue may receive the treatment, subject to product, use, customs and regulatory conditions.
“Goods can then be sold anywhere in mainland China without import taxes.” Second-line entry generally triggers import taxes. The 30% processing route can exempt qualifying goods from import duty, but it is conditional and does not automatically remove import VAT or consumption tax.
“Every Hainan company pays 15% CIT.” The company must satisfy the encouraged-industry, qualifying-revenue and substantive-operation gates.
“An EF account permits unrestricted capital flows.” EF transfers remain inside a regulated banking system. Banks conduct KYC, AML and transaction review; second-line transfers face currency, quota, counterparty and negative-list controls.
“The tax policies are permanent after customs closure.” The current CIT and qualifying talent IIT periods run through 31 December 2027. Any later continuation requires new official rules.
“Hainan replaces Hong Kong or Singapore.” Hainan can be an effective onshore China operating, trade and processing base. Hong Kong and Singapore have different legal, tax, currency and regional-headquarters functions. Model the downside case and monitor the Ministry of Finance, State Taxation Administration and Hainan authorities for new rules.
