Hiring Employees in Hainan: 2026 Labor Law Guide for Foreign Employers (Costs, Contracts & Compliance)

Setting up a Hainan company was the easy part. Now the business needs people—and China’s employment rules can feel like a second registration process.
The opportunity is real. Hainan can offer lower salary expectations than China’s largest cities for some roles, while Haikou, Sanya and specialist parks attract technology, trade, tourism, finance and agricultural talent. The risk is assuming that a lower base salary equals a low total employment cost.
An employer must budget the salary, employer social insurance, housing fund, bonuses, leave, payroll administration and possible severance. It also needs a written contract, lawful working-time system, internal rules and accurate monthly filings.
This guide provides the operating framework for a foreign-owned company: choose the hiring model, issue the right contract, estimate total cost, onboard local or foreign staff, run payroll and manage exits. Employment contracts: types and key terms
China’s Labor Contract Law recognizes three principal contract terms:
- a fixed-term contract ends on an agreed date and is common for an initial hire;
- an open-ended contract has no agreed expiry date, although lawful termination remains possible; and
- a contract for completion of a defined task ends when the agreed task is completed.
The official Labor Contract Law text contains the detailed rules. An employee with ten continuous years at the employer can have a right to an open-ended contract in the statutory circumstances. The same can apply when two consecutive fixed-term contracts have been concluded and the parties renew, provided the employee does not fall within the specified statutory exceptions and does not request another fixed term.
Do not reduce that rule to “the third contract is always open-ended.” The renewal facts, employee request and statutory grounds matter. Calendar the first two contracts and obtain advice before the second expiry.
Labor dispatch and part-time work are separate hiring arrangements, not substitutes for the three contract terms. Dispatch is regulated and generally limited to temporary, substitute or auxiliary positions. Non-full-time employment generally averages no more than four hours per day and no more than 24 hours per week with the same employer; no probation may be agreed, and payment intervals are shorter.

The same employer may agree only one probation with the same employee. Probation pay must satisfy the statutory 80% tests and cannot fall below the local minimum wage. A probation clause is not a free-termination clause; the employer still needs a lawful reason and evidence.
A written contract should cover the employer and employee, term, work content and location, working hours and rest, pay, social insurance, labor protection and other mandatory items. Add role objectives, confidentiality, IP ownership, data handling, expenses and lawful restrictive covenants where relevant.

Salary benchmarks: what should a Hainan employer budget?
The ranges below are planning estimates, not official wage data or guaranteed market offers. City, language, sector, seniority, bonus, remote-work policy and scarce technical skills can move a role well outside the range.

The currency conversion uses a rounded reference derived from the European Central Bank’s July 2026 reference rates. It is for regional budgeting, not payroll or foreign-exchange execution.
Do not apply a universal statement that Hainan salaries are exactly 70–80% of Shenzhen or 60–70% of Shanghai. An administrative role may be materially cheaper; a specialist in tropical agriculture, aerospace, biomedical research or cross-border finance may command a national or international rate.
Build the offer from the role: fixed salary, variable bonus, statutory contributions, leave, commercial insurance, relocation, housing, equity and termination exposure. Social insurance and housing fund: mandatory employment costs
China’s “five insurances and one fund” framework covers pension, medical, unemployment, work injury, maternity and the housing provident fund. Medical and maternity collection may be integrated, while rates and bases change by province, year, category and programme.

Hainan’s official 2024–2026 medical-rate adjustment sets the employer basic medical contribution at 6% from July 2024 through December 2026, excluding maternity insurance, unless a new rule intervenes.
Contribution bases are published or adjusted periodically. Do not hard-code “RMB 4,000–20,000” as the 2026 Hainan range without checking the current social-insurance and housing-fund notices for the employee’s city and month.
Example: RMB 10,000 monthly salary
Using a RMB 10,000 contribution base and illustrative employer rates of 16% pension, 6% medical, 0.5% unemployment, 0.4% work injury and 8% housing fund gives:
- salary: RMB 10,000;
- pension: RMB 1,600;
- medical: RMB 600;
- unemployment: RMB 50;
- work injury: RMB 40; and
- housing fund: RMB 800.
The illustrative employer cost is RMB 13,090 before any separate maternity or long-term-care charge, benefits, bonus, leave accrual or payroll fee. The actual result can be higher or lower because the contribution base may differ from cash salary and the current rates may differ from the assumptions.
Singapore CPF and Chinese social insurance should not be compared by percentage alone. They cover different benefits, contribution ceilings, workforces and legal systems.
Hiring foreign employees in Hainan
A foreign national working in Hainan generally needs the appropriate work permit and a work-type residence permit. A business visa or visa-free entry does not authorize ordinary employment.
Hainan uses three work-permit categories:
- Category A: high-end foreign talent, using national or Hainan criteria and facilitation routes;
- Category B: foreign professionals meeting an applicable education, experience, salary, points or special route; and
- Category C: other foreign personnel responding to labor-market and Free Trade Port needs, often managed through catalogues, points or quotas.
The Hainan work-permit guide explains that education, experience, salary, age, awards, patents and Chinese proficiency can all affect the category. It is too simplistic to describe every Category A applicant as earning at least RMB 600,000 or every Category B applicant as necessarily having a bachelor’s degree plus exactly two years’ experience; multiple routes exist.
The operating sequence normally includes:
- select the candidate and confirm the permit route;
- collect the passport, degree, work-experience, no-criminal-record, medical and employment documents;
- arrange an Apostille, authentication or verification as applicable;
- have the Hainan employer file the work-permit application;
- obtain the appropriate entry document if the person is abroad;
- complete post-entry work-permit formalities; and
- apply for the work-type residence permit within the applicable deadline.
Hainan provides streamlined service and updated guidance, but “15-day joint approval” should not be treated as a universal end-to-end guarantee. The residence-permit decision alone can have a published window of up to 15 working days after acceptance, and document preparation can be the longest step. Screen the candidate before making an unconditional start-date promise.
Local recruitment is usually stronger for administration, finance, operations and domestic sales. A foreign hire may be justified for regional leadership, technical know-how, language, overseas customers or technology transfer. The work-permit role, employment contract and actual work must agree.
Payroll processing: withholding and monthly compliance
Payroll is a monthly evidence chain, not only a bank transfer.
An employer that does not build this function internally can use payroll outsourcing in China while retaining legal responsibility for accurate pay, filings and employment records.
- lock approved salary, attendance, leave, bonus and expense data;
- calculate gross pay and employee statutory deductions;
- calculate individual income tax withholding;
- approve the payroll through controlled roles;
- pay salary from the company bank account;
- declare and pay tax, social insurance and housing fund; and
- reconcile the payroll register, bank, ledgers and filings.
A person domiciled in China or present for 183 days or more in a tax year can be a resident individual under the national IIT rules, subject to detailed domicile and multi-year provisions. Qualifying high-end and urgently needed talent may be exempt from the portion of actual Hainan IIT burden exceeding 15%. The current policy is extended through 2027, but the person must meet the Hainan list, work, income, residence and annual-settlement requirements. It is not a flat 15% payroll withholding rate for all foreign or technology employees.
The national foreign-individual allowance policy is also extended through 2027. An eligible resident foreign individual can choose qualifying tax-exempt allowances—such as supported housing, language training and children’s education—or the applicable special additional deductions, but not both in the same tax year. Documentation and reasonableness matter.

Termination rules: plan the route before acting
China does not use a general employment-at-will model. The company needs a lawful route and procedure.
- Mutual separation: the parties sign a clear agreement covering date, compensation, handover, property and claims.
- Employee-fault dismissal: serious misconduct or another statutory ground requires valid rules, evidence and procedure.
- Non-fault termination: incapacity after medical treatment, incompetence after training or reassignment, or a major objective change can apply under defined conditions, normally with notice or payment in lieu.
- Economic redundancy: statutory thresholds, conditions, consultation and reporting may apply.
- Expiry: a fixed-term contract can end at expiry, but compensation and open-ended-contract rights must be checked.
Economic compensation is generally calculated as N × monthly wage, with N based on service years and partial-year rules. The three-times-local-average-wage cap and maximum 12-year service count apply to the statutory high-wage case; they are not a universal 12-year cap for every employee.
An unlawful termination can expose the employer to reinstatement or compensation at twice the economic-compensation standard. Protected situations—including specified occupational disease, work injury, medical-treatment, pregnancy, maternity and nursing circumstances—require particular care.
Preserve the contract, policies, acknowledgements, performance goals, training, warnings, consultation and decision records. Obtain employment counsel before communicating a contested termination; a technically correct reason can still fail through defective evidence or procedure.
