Hainan Visa and Residency for Entrepreneurs: A 2026 Planning Guide
A practical guide for foreign founders visiting, working and residing in Hainan, covering 61-country visa-free entry, work permits, residence permits and permanent residence routes.

A foreign founder can own a Hainan company without living in China. But once the founder starts managing staff on the ground, performing day-to-day work or relocating family, company registration and immigration status must be planned together.
The most common mistake is treating easy entry as work authorization. Hainan’s visa-free policies can support a scouting trip, negotiations and short-term business visits. They do not authorize employment. A founder actively working for the Hainan entity normally needs a foreigner’s work permit and a work-type residence permit.
This guide organizes the options by activity: visit, conduct short-term business, work, reside and pursue long-term status.
Start with the activity, not the visa label

Before travel, check passport nationality, purpose, route, port, duration, travel beyond Hainan and whether work will be performed. China also operates national mutual and unilateral visa exemptions and a 240-hour transit scheme; the best route may not be the Hainan-only policy.
Hainan’s 61-country visa-free entry
The National Immigration Administration’s current regional visa-free policy permits ordinary-passport holders from 61 listed countries to enter Hainan for up to 30 days for tourism, business, visits, family visits, medical treatment, exhibitions and sports competitions. Work and study are excluded.
The list includes Singapore, Malaysia, Thailand, Indonesia, the Philippines and Brunei, as well as the United States, United Kingdom, Canada, Australia, New Zealand and many European countries. Check the official list rather than relying on an old travel article.
The Hainan-only route generally requires entry and exit through an open Hainan port and limits activity to Hainan’s administrative region. A traveller who needs to go to mainland China for a legitimate reason should address the required visa or use a different entry policy. The current provincial guide also states that a person with a legitimate need to extend should apply before the visa-free period expires; approval should never be assumed.
Foreign visitors staying outside a hotel must complete accommodation registration with the local public-security authority within 24 hours. Hotels normally handle this for guests.

What can a founder do during the visit?
Permitted business activity can include meetings, negotiations, partner visits, market research and viewing offices. Activities that look like employment—holding an operational position, delivering day-to-day services, managing staff as local work or receiving local employment remuneration—need the proper work route.

The normal work and residence route
For employment lasting more than 90 days, the official sequence is generally:
- the Hainan employer registers on the foreigner work-management system;
- the employer applies for a Foreigner’s Work Permit Notification;
- the applicant obtains the appropriate entry visa from a Chinese embassy or consulate;
- after entry, the employer completes work-permit formalities within the applicable period; and
- the foreign national applies for a work-type residence permit within 30 days after entry where required.
Since December 2024, work-permit information has been integrated with China’s social-security card system, and applications are increasingly digital. Hainan also provides combined service windows in some locations. This is procedural facilitation, not a relaxation of eligibility.
The official Hainan working guide describes Categories A, B and C. Category A covers high-level talent under national or Hainan criteria, including certain applicants whose salary reaches the stated multiple of the provincial average. Category B includes foreign professionals who satisfy education, professional or other qualifying routes. The authority assesses the actual role and evidence.
Typical documents include passport, photo, employment contract, employer records, degree or professional qualification, work-experience evidence, criminal-record documentation, health examination where applicable and authenticated or verified overseas documents. Requirements vary by category and document origin.
2026 Update: Work Permit Mutual Recognition
Measure 11 of Hainan’s April 2026 Three-Year Action Plan for Optimizing Foreign-Related Services and Enhancing the International Business Environment calls for a smoother work-permit transition in specified cases:
- Eligible holders of permits from partner regions. Where a foreign national holds a valid work permit issued in a region with a cooperation mechanism with Hainan, the Hainan process is to be simplified and recognition and handling made more efficient.
- People covered by Hainan’s foreign-worker catalogue. The plan calls for convenience for qualifying foreign professionals applying for work authorization from within mainland China.
- Regional coordination. It highlights deeper linkage with the Guangdong–Hong Kong–Macao Greater Bay Area and cooperation with Beijing–Tianjin–Hebei, the Yangtze River Delta and other regions.
This is a facilitation pathway, not an automatic transfer or nationwide mutual-recognition rule. The cooperation mechanism, Hainan employer, job, documents and individual eligibility must still be confirmed. Before resigning or cancelling an existing permit, check the current process with both the issuing authority and the Hainan receiving authority.
Founders, legal representatives and investors
Being a shareholder, director or legal representative does not by itself grant permission to work. If a founder is actively managing the Hainan business from the island, the role, contract, compensation and work-permit category should be consistent.
Some high-level talent, urgently needed specialists and investors may be able to apply for residence status after entering on another status, subject to approval. The official Hainan residence guide warns that applicants outside specified categories may need to leave China and obtain the proper visa at a consular mission. Do not build a relocation schedule around an assumed in-country conversion.
Residence-permit decisions are made after the application is accepted and reviewed. The official service guide gives an acceptance-receipt period of up to 15 working days. Document preparation, work authorization and consular steps occur before that window and can take longer.
Family members and dependants
Spouses, parents and children may use family-reunion or private-affairs routes depending on the relationship and the principal applicant’s status. Documents commonly include relationship certificates, invitations and the principal person’s passport and residence records.
A dependant residence permit does not automatically authorize employment. A spouse who accepts a Hainan role should obtain their own work authorization and compatible residence status.
Plan school admissions, housing, health insurance and document legalization early. These practical items often determine the relocation date more than the company licence does.
Permanent residence: possible routes, no guarantee
China’s permanent residence is a separate national status. Hainan has published facilitation measures for specified groups, including:
- overseas Chinese with a doctoral degree working in Hainan;
- overseas Chinese who have worked continuously in Hainan for four years and lived there at least six months each year;
- foreigners investing in an innovative enterprise with stable investment and good tax records for three consecutive years, subject to provincial recommendation; and
- foreigners working continuously in Hainan for four years who satisfy the applicable salary-income and annual IIT standards.
The National Immigration Administration’s published Hainan measures provide the policy outline. The actual route requires current criteria, original evidence, authority review and approval. A four-year work history or a capital injection does not guarantee permanent residence.
Treat permanent residence as a later evidence project. Preserve work permits, residence permits, contracts, payroll, IIT, social insurance, investment records, company accounts and physical-residence records from year one.
The five-star card gets more useful
Measure 10 of the same action plan calls for more convenient use of the foreigner’s permanent residence ID card in government services, public transport, financial services, medical care and internet payments.
This is an everyday-use improvement for people who already hold permanent residence, not a new eligibility route. Permanent-residence approval remains a separate national immigration decision, while individual platforms and service providers may complete technical acceptance on different schedules. Confirm the current supported scenarios rather than assuming universal acceptance.
A staged plan for an overseas entrepreneur
Stage 1: scouting
Use an eligible short-term entry route for meetings and site selection. Avoid employment activities. Confirm how travel beyond Hainan affects the chosen policy.
Stage 2: company formation
Register the company, set realistic five-year capital commitments, secure premises and open banking and tax accounts. Read the step-by-step company registration guide.

Define the founder’s operational role, appoint the Hainan employer, prepare authenticated documents and apply for the work route before relocating.
Stage 4: annual maintenance

Stage 5: long-term status
Only after the factual record is established should the founder assess a longer residence period or permanent residence route with the competent authority.
Common questions
Can I enter visa-free and sign company documents?
Short-term business and visits are permitted under the 61-country route. Signing as an investor is different from working day to day; keep the activities within the entry purpose.
Does an R visa replace a work permit?
No. An R visa can facilitate entry for qualifying talent, but work authorization and residence formalities still need to be completed as applicable.
Can I travel to Guangzhou under the Hainan 61-country policy?
Not under the Hainan-only geographical scope. Obtain the necessary visa or use a national policy that covers the planned itinerary.
How quickly is a residence permit issued?
The published decision period after acceptance can be up to 15 working days. Preparation and work-permit steps can extend the total timeline.
Is there a digital-nomad visa for Hainan?
Current official categories do not describe a general Hainan digital-nomad visa. Remote work performed while physically in China can raise immigration, tax and data issues; obtain advice for the actual arrangement.
I already have a work permit from another Chinese city. Is it easier to move to Hainan?
Potentially. Hainan’s April 2026 action plan calls for simplified processing for eligible holders of valid work permits issued in regions that have established a cooperation mechanism with Hainan. The plan highlights linkage with the Greater Bay Area and cooperation with other major regions.
It is not an automatic transfer. Confirm that the current permit-issuing region is covered and that the Hainan employer, role and individual profile meet the receiving authority’s requirements before changing employment.
